What are your rights?

 

As the data subject, you have the right to request the Data Controller to exercise the following rights:

  • Access: access the data in our possession and request a copy, except where the exercise of the right would infringe upon the rights and freedoms of other individuals;
  • Rectification: request the rectification of any incomplete or inaccurate data;
  • Erasure: request the erasure of data, where applicable, subject to the exclusions established in Article 17.3 GDPR;
  • Restriction: request the restriction of processing, where applicable, subject to the exclusions established in Article 18.2 GDPR;
  • Portability: request the portability of data (i.e., receive them in a structured, commonly used, and machine-readable format to transmit them to another controller without hindrance), to the extent that processing is based on consent or the necessity of performing a contract, where technically feasible and unless the exercise of the right would infringe upon the rights and freedoms of other individuals;
  • Complaint: lodge a complaint with the Data Protection Authority of the state concerned or the Data Protection Authority of the EU Member State where you habitually reside or work, or the place where the alleged violation occurred.
  • The data subject also has the right to revoke any consent given; such revocation does not affect the processing of data carried out prior to it.

    Right to Object:
    When Personal Data is processed to pursue a legitimate interest of Talent Garden, the data subject has the right to object to the processing for reasons related to their particular situation, unless there are compelling and legitimate grounds for the processing pursuant to Article 21.1 GDPR, and provided that the processing is not necessary for the establishment, exercise, or defence of a legal claim. It is noted that, if the data subject's data is processed for direct marketing purposes, the data subject can object to the processing without providing any justification.
